Man sues Dunbar, officer for injuries from traffic stop, assault

CHARLESTON — A Kanawha County man says the City of Dunbar and one of its officers caused him severe physical pain.

Khristopher Tolliver claims he was driving to work as a night cleaner at Citi National Bank in Dunbar on April 29 with Officer Lester, who was in the parking lot and immediately stopped him and told him to get back into his vehicle, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

Tolliver claims when he informed Lester he was just going to work, Lester charged him, tackled him to the ground and assaulted him before arresting him.

After the arrest, he was taken to the police department and the report said he was stopped for “suspicious activity,” according to the suit.

Tolliver claims he sustained both emotional and physical harm because of Lester’s actions.

Tolliver is seeking compensatory damages. He is represented by Faun S. Cushman of Pritt and Spano in Charleston.
