CHARLESTON — A motorist is suing Ward’s Automotive Inc., an auto repair shop, citing alleged breach of duty and negligence after a wheel allegedly came off her car at highway speeds.
Patressa Moore filed a complaint on July 27 in Kanawha Circuit Court against Ward’s Automotive Inc. alleging that the auto repair shop breached its duty of reasonable care in replacing her tires.
According to the complaint, the plaintiff alleges that on July 11, 2014, she was traveling at approximately 70 mph when suddenly, her left rear wheel and tire detached from her vehicle, causing it to swerve and shake violently and throwing her around the interior of the vehicle. She suffered property damage, serious and permanent injuries, pain and mental anguish, loss of enjoyment of life and medical expenses, the suit alleges. The plaintiff holds Ward’s Automotive Inc. responsible because defendant’s employee allegedly negligently and carelessly replaced the tires of her car and breached its duty of reasonable care in making repairs in a skillful and workmanlike manner.
The plaintiff requests a trial by jury and seeks compensatory damages to be determined by the trier of facts, plus pre- and post-judgment interest and such other relief as jury may deem just. She is represented by Joseph Spano of Pritt & Spano PLLC in Charleston.
